Pick-Up Requirements

-Pick-up hours are Monday through Thursday, 9:00 a.m. – 3:00 p.m.

-Pickups must be scheduled at least one (1) City of Henderson business day in advance.

-Failure to remove item(s) within the timeframe specified in the auction listing may result in

storage fees, forfeiture, or resale of the item(s), at the City’s discretion, without refund.

All items are sold AS-IS, WHERE-IS, WITH ALL FAULTS. The City of Henderson makes no

warranty, guarantee, or representation of any kind, express or implied, including but not

limited to warranties of merchantability or fitness for a particular purpose, as to the

condition, quality, description, usability, or safety of any item offered for sale.

Item descriptions are provided to the best of the City’s knowledge but are not guaranteed.

Bidders are solely responsible for conducting their own inspection and due diligence prior

to bidding. Failure to inspect shall not constitute grounds for cancellation or refund.

All sales are final. No returns or refunds will be permitted for any reason. The City of

Henderson reserves the right to reject any bid and/or cancel a sale at its sole discretion.

The successful bidder (“Buyer”) assumes all responsibility and risk of loss, damage, or

injury to persons or property arising from the sale, possession, loading, removal,

transportation, use, or disposition of the item(s) purchased.

Title and risk of loss transfer to Buyer immediately upon release of the item(s).

Buyer is solely responsible for all packing, loading, securing, removal, shipping, and

transportation of purchased item(s). Buyer must provide all necessary tools, equipment,

vehicles, and personnel required to safely remove the item(s).

The City of Henderson will not provide assistance with loading, moving, or transporting

item(s).

Buyer agrees to indemnify, defend, and hold harmless the City of Henderson, its officers,

employees, and agents from and against any and all claims, demands, damages, losses,

liabilities, costs, or expenses (including attorney’s fees) arising out of or related to Buyer’s

purchase, removal, transportation, possession, use, or resale of the item(s).

If a third party is authorized to pick up item(s) on Buyer’s behalf, Buyer must provide written

authorization via email to Purchasing@cityofHenderson.com prior to release. Items will not

be released without such authorization. The City assumes no responsibility for verifying the

identity of third-party agents beyond reasonable measures.
